1. Who we are and what these terms cover
These terms are between you and Hevelly Tech SL ("Hevelly", "we"), [Registered address], Spain, NIF [NIF]. They cover the Hevelly app at https://app.hevelly.com, the website at https://hevelly.com, the optional account, and the Hevelly Plus subscription once it is available. By using the app you accept them. When you create an account you confirm this by ticking a box, and we record which version of these terms and of the privacy policy you accepted, and when. If you do not agree, do not use the app.
2. What Hevelly is
Hevelly is a tool for keeping track of your own net worth, subscriptions and gift cards. You type the figures in; the app stores them on your device, keeps a history as you close cycles, fetches exchange rates and prices to value what you entered, and shows you the result. It does not connect to banks, brokers or exchanges, does not hold or move money, and does not buy, sell, cancel or pay anything on your behalf. Actions in the app such as "Log a buy" only change your records.
3. Not financial advice
Nothing in Hevelly is financial, investment, tax or legal advice. The figures, trends, splits and the "cash lasts" estimate are arithmetic on the numbers you entered and on third-party rates and prices that may be delayed or wrong. Decisions about your money are yours. If you need advice, ask a qualified professional.
4. Your data and your responsibility for backups
Your figures live in your browser on your device. We do not have them and cannot restore them. Keep a backup: the app can save a backup file at any time, and a free account can keep one encrypted cloud backup. Clearing your browser's site data, losing the device or forgetting your backup passphrase can mean the data is gone for good; we cannot recover an encrypted backup without the passphrase, by design.
5. Accounts
- An account is optional and free. You sign in with a one-time code sent to your email; keep access to that mailbox, since it is your only key to the account.
- You must be at least 14 years old to create an account, and give us a working email address.
- One account is for one person. Do not share your sign-in codes.
- You can delete your account at any time from Settings. We may close accounts that break these terms, after telling you unless the law or security prevents it.
6. Acceptable use
You agree not to:
- use the app or website for anything unlawful;
- try to gain access to other people's accounts or data, or to our systems beyond what the app offers;
- overload, probe or interfere with the service, or use automated means to pull data from it;
- copy, resell or sublicense the app, or remove our notices from it.
7. Hevelly Plus (when available)
- Hevelly Plus is a paid monthly subscription that adds continuous end-to-end encrypted sync across your devices and a history of your last 30 backups. The price, including VAT where it applies, is shown before you pay and on the pricing page.
- The subscription renews each month until you cancel. You can cancel at any time from Settings or by email; it then runs to the end of the period you have paid for and stops. After the 14 days below, payments for the current period are not refunded.
- As a consumer in the EU you have 14 days from the purchase to withdraw without giving a reason. Plus starts within those 14 days only if you ask for that at checkout and acknowledge that, if you then withdraw, a proportional amount for the days you used is kept from the refund. How that works is on the refunds and cancellation page, which forms part of these terms.
- When Plus ends, for whatever reason, your latest backup stays as the free plan's single backup and the history of earlier versions is removed.
- If we change the price, we tell you by email at least 30 days before it applies to you, and you can cancel before it does.
- Payments are handled by a payment provider; we never see or store your card details. If a payment fails, we tell you and retry; if it keeps failing, Plus features stop and your account goes back to the free plan, with your latest backup kept.
8. Intellectual property
The app, the website, the Hevelly name and marks, and their design and code belong to Hevelly Tech SL or our licensors. We grant you a personal, non-exclusive, non-transferable right to use the app for your own purposes under these terms. The figures and notes you enter are yours.
9. Availability and changes
We work to keep the app and the account service available, but we do not promise uninterrupted availability. Rates and prices depend on third parties and may be missing or stale; the app says when they are. We may change, add or remove features; if a change removes something material from a paid plan, we tell subscribers in advance and they can cancel. Because the app runs in your browser, you can keep using an installed copy offline even while the service is down.
10. Liability
We are liable for damage we cause intentionally or through gross negligence, and for anything the law does not let us exclude, including your rights as a consumer under Spanish and EU law. Beyond that, to the extent the law allows: for the free app and account we are not liable for indirect losses or for loss of data you did not back up; for Hevelly Plus our total liability in any twelve-month period is limited to the amount you paid us in that period. Nothing here limits liability for death or personal injury caused by our negligence.
11. Ending the agreement
You can stop using the app at any time and delete your account from Settings. We can end the agreement if you break these terms or if we stop offering the service, in which case we tell you in advance where we can, and refund any part of a paid period you have not received.
12. Governing law and disputes
These terms are governed by Spanish law. If you are a consumer living in another EU country, you also keep the protection of the mandatory consumer law of your country, and you may bring a claim in the courts where you live. We prefer to sort things out directly: write to hello@hevelly.com first.
13. Changes to these terms
When we change these terms we update the date at the top. For changes that matter, we tell account holders by email at least 30 days before they take effect. If you keep using the app after that, the new terms apply; if you do not agree, delete your account and stop using it.
